It handles complaints regarding <strong><em><a title=\"Human Rights\" href=\"https:\/\/www.europewatchdog.info\/en\/council-of-europe\/core-values\/human-rights\/\">human rights<\/a><\/em><\/strong> violations, lodged by individuals or groups of individuals against a member state as well as complaints made by a member state against another member state.<\/p>\n<p>&nbsp;<br \/>\n<strong>The Purpose of the Court<\/strong><\/p>\n<p>Contrary to popular belief the European Court of Human Rights (ECtHR) is not a pan-European supreme court, but a specialised legal institution: Based on the <strong><em><a title=\"European Convention on Human Rights (ECHR)\" href=\"https:\/\/www.europewatchdog.info\/en\/convention-on-human-rights\/\">European Convention on Human Rights (ECHR)<\/a><\/em><\/strong>, the Court determines whether a state has violated the <strong><em><a title=\"Human Rights\" href=\"https:\/\/www.europewatchdog.info\/en\/council-of-europe\/core-values\/human-rights\/\">human rights<\/a><\/em><\/strong> of an applicant &#8211; be it through the exercise of state authority in general, within the framework of court proceedings or by a court decision.<\/p>\n<p><img decoding=\"async\" class=\"wp-image-4920 alignleft\" style=\"border: 0px none;\" src=\"https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/COE-logo-ECHR.png\" alt=\"\" width=\"280\" srcset=\"https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/COE-logo-ECHR.png 662w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/COE-logo-ECHR-300x115.png 300w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/COE-logo-ECHR-560x215.png 560w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/COE-logo-ECHR-260x100.png 260w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/COE-logo-ECHR-160x61.png 160w\" sizes=\"(max-width: 662px) 100vw, 662px\" \/>Every human being within the jurisdiction of a <strong><em><a title=\"Council of Europe\" href=\"https:\/\/www.europewatchdog.info\/en\/council-of-europe\/\">Council of Europe<\/a><\/em><\/strong> member state &#8211; even citizens of non-European countries &#8211; who considers her or his <strong><em><a title=\"Human Rights\" href=\"https:\/\/www.europewatchdog.info\/en\/council-of-europe\/core-values\/human-rights\/\">human rights<\/a><\/em><\/strong> violated by the state is free to lodge a complaint, after having exhausted all national remedies. Moreover, it is entirely irrelevant, whether the person, who lodges a complaint, is a respectable citizen or a lawfully convicted criminal, because the rights and freedoms specified in the <strong><em><a title=\"European Convention on Human Rights (ECHR)\" href=\"https:\/\/www.europewatchdog.info\/en\/convention-on-human-rights\/\">European Convention on Human Rights (ECHR)<\/a><\/em><\/strong> are guaranteed to all human beings alike.<\/p>\n<p>&nbsp;<br \/>\n<strong>The Judges<br \/>\n<\/strong><\/p>\n<p><a href=\"https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/Grosse-Kammer.jpg\"><img decoding=\"async\" class=\" wp-image-4736 alignright\" style=\"border: 1px solid black;\" src=\"https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/Grosse-Kammer.jpg\" alt=\"\" width=\"250\" srcset=\"https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/Grosse-Kammer.jpg 610w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/Grosse-Kammer-300x180.jpg 300w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/Grosse-Kammer-560x336.jpg 560w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/Grosse-Kammer-260x156.jpg 260w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2014\/01\/Grosse-Kammer-160x96.jpg 160w\" sizes=\"(max-width: 610px) 100vw, 610px\" \/><\/a>Every member state has the right to send one judge to the Court. Every judge is elected by the <strong><em><a title=\"Parliamentary Assembly\" href=\"https:\/\/www.europewatchdog.info\/en\/structure\/parliamentary-assembly\/\">Parliamentary Assembly<\/a><\/em><\/strong> of the <strong><em><a title=\"Council of Europe\" href=\"https:\/\/www.europewatchdog.info\/en\/council-of-europe\/\">Council of Europe<\/a><\/em><\/strong> from a list of three candidates for a nonrecurring nine-year term of office. The judges represent not the interests of their countries of origin, but those of the European Court of Human Rights (ECtHR).<\/p>\n<p>The Court&#8217;s hearings take place within the framework of either the Small Chamber with 7 judges or the Grand Chamber with 17 judges.<\/p>\n<p>&nbsp;<br \/>\n<strong>The judgments of the Court<\/strong><\/p>\n<p>If the Court has found a member state guilty of violating the human rights as defined in the <strong><em><a title=\"European Convention on Human Rights (ECHR)\" href=\"https:\/\/www.europewatchdog.info\/en\/convention-on-human-rights\/\">European Convention on Human Rights (ECHR)<\/a><\/em><\/strong>, the offending state hast to:<\/p>\n<ul>\n<li>pay material damages to the applicant in accordance with the Court&#8217;s orders<\/li>\n<li>eliminate the ramifications of the violation<\/li>\n<li>take the necessary steps to insure that the same kind of violation can&#8217;t be repeated in the future<\/li>\n<li>publish the judgement in the relevant national legal journals<\/li>\n<\/ul>\n<p>The judgments of the Court are made public. They are final and legally binding.<\/p>\n<p>&nbsp;<br \/>\n<strong>The execution of the judgments of the Court<\/strong><\/p>\n<p>The <strong><em><a title=\"Committee of Ministers\" href=\"https:\/\/www.europewatchdog.info\/en\/structure\/committee-of-ministers\/\">Committee of Ministers<\/a><\/em><\/strong> of the <strong><em><a title=\"Council of Europe\" href=\"https:\/\/www.europewatchdog.info\/en\/council-of-europe\/\">Council of Europe<\/a><\/em><\/strong> supervises the <strong><em><a title=\"Supervision of the Execution of Judgments\" href=\"https:\/\/www.europewatchdog.info\/en\/court\/supervision-execution-judgments\/\">execution of the Court&#8217;s judgments<\/a><\/em><\/strong>. It assists the state in question in trying to find suitable measures in order to comply with the demands made by the Court. The obligation to eliminate the ramifications of the human rights violation as well as to prevent the violation from happening again in the future may lead to changes in the national legislation of the state in question.<\/p>\n<p>&nbsp;<br \/>\n<strong>Interim measures<\/strong><\/p>\n<p>Sometimes, only immediate action can prevent people from getting harmed seriously and irreversibly. Therefore, every person in a <strong><em><a title=\"Council of Europe\" href=\"https:\/\/www.europewatchdog.info\/en\/council-of-europe\/\">Council of Europe<\/a><\/em><\/strong> member state has the right to apply to the European Court of Human Rights for an interim measure. Most often, these requests concern the suspension of a pending expulsion or extradition, because, for specific reasons, the person concerned fears death, prison or torture upon arrival in the country of destination.<\/p>\n<p>The Court examines each request carefully on an individual and priority basis, taking into consideration all available information. An interim measure is only issued where the Court concludes that the applicant faces a real risk if the measure is not applied, and time is of the essence. This is for example the case when a person is about to be deported to a country where their life is threatened. In 2025, 222 out of 2&#8217;701 requests were granted (8,2%).<br \/>\n&nbsp;<br \/>\n<strong>Impact<\/strong><\/p>\n<p>Judgments delivered by the European Court of Human Rights have led to the improvement of people\u2019s lives across Council of Europe member States.
