{"id":6695,"date":"2015-03-17T18:46:50","date_gmt":"2015-03-17T17:46:50","guid":{"rendered":"http:\/\/www.europewatchdog.info\/?page_id=6695"},"modified":"2024-09-27T07:55:14","modified_gmt":"2024-09-27T06:55:14","slug":"money-laundering","status":"publish","type":"page","link":"https:\/\/www.europewatchdog.info\/en\/treaties_and_monitoring\/money-laundering\/","title":{"rendered":"Money Laundering"},"content":{"rendered":"<p>Money laundering serves to legalise the profits made through criminal activities like drug trafficking, prostitution, illegal arms sales, trafficking in human beings, smuggling, embezzlement, insider trading, bribery, computer fraud etc. Therefore, it is being combated at national as well as international level and the expert bodies of the different intergovernmental stakeholders work in close co-operation.<br \/>\n&nbsp;<br \/>\n&nbsp;<br \/>\n<strong>Council of Europe treaties<\/strong><\/p>\n<p><a href=\"http:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-GeldLupe.png\"><img decoding=\"async\" class=\"alignright wp-image-6698\" src=\"http:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-GeldLupe.png\" alt=\"\" width=\"250\" height=\"150\" srcset=\"https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-GeldLupe.png 1122w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-GeldLupe-300x180.png 300w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-GeldLupe-1024x616.png 1024w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-GeldLupe-560x337.png 560w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-GeldLupe-260x156.png 260w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-GeldLupe-160x96.png 160w\" sizes=\"(max-width: 250px) 100vw, 250px\" \/><\/a>In order to fight money laundering comprehensively, the <strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/council-of-europe\/\" title=\"Council of Europe\">Council of Europe<\/a><\/em><\/strong> has drawn up several <strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/international-treaties\/\" title=\"International Treaties\">treaties<\/a><\/em><\/strong>.<\/p>\n<p>Some of them are directly linked to money laundering, some of them are related to the issue.<\/p>\n<p>&nbsp;<\/p>\n<p>Conventions on money laundering:<\/p>\n<ul>\n<li>Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime (CETS No. 141)<\/li>\n<li>Council of Europe Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime and on the Financing of Terrorism (CETS No. 198)<\/li>\n<\/ul>\n<p>Conventions related to the issue of money laundering:<\/p>\n<ul>\n<li><strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/partial-agreements\/corruption\/\" title=\"Fight against Corruption \u2013 and GRECO\">Criminal Law Convention on Corruption (CETS No. 173)<\/a><\/em><\/strong><\/li>\n<li><strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/treaties_and_monitoring\/fight-against-terrorism\/\" title=\"Fight against Terrorism\">European Convention on the Suppression of Terrorism (CETS No. 090)<\/a><\/em><\/strong><\/li>\n<li><strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/treaties_and_monitoring\/fight-against-terrorism\/\" title=\"Fight against Terrorism\">European Convention on the Prevention of Terrorism (CETS No. 196)<\/a><\/em><\/strong><\/li>\n<li><strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/treaties_and_monitoring\/cybercrime\/\" title=\"Fight against Cybercrime\">European Convention on Cybercrime (CETS No. 185)<\/a><\/em><\/strong><\/li>\n<li>European Convention on the Transfer of Proceedings in Criminal Matters (CETS No. 073)<\/li>\n<li>European Convention on Mutual Assistance in Criminal Matters (CETS No. 030)<\/li>\n<li>European Convention on Extradition (CETS No. 024)<\/li>\n<\/ul>\n<p>&nbsp;<br \/>\n<strong>The <em>Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime<\/em> <\/strong>(CETS No. 141)<\/p>\n<p>This landmark treaty entered into force in 1993. It has been ratified by all Council of Europe member states and is open for signature to all states, which have participated in its elaboration.<\/p>\n<p>The Convention asks State parties to:<\/p>\n<ul>\n<li>adopt the necessary legislative and other measures to identify, trace and confiscate illicit property of any kind<\/li>\n<li>prevent any dealing in, transfer or disposal of such property<\/li>\n<li>empower its authorities to order that &#8211; where criminal activity is suspected &#8211; bank, financial or commercial records be made available without regard to bank secrecy<\/li>\n<li>legalise the use of special investigative techniques like monitoring, observation, interception of telecommunications, access to computer systems and orders to produce specific documents when criminal activity is suspected<\/li>\n<\/ul>\n<p>Furthermore, the State parties are asked to make punishable under their domestic law laundering offences such as:<\/p>\n<ul>\n<li>concealing or disguising the true nature, origin, location, disposition, movement, or ownership of illicit property<\/li>\n<li>the acquisition, possession or use of such property<\/li>\n<li>assisting any person who is involved in any of these illegal actions to evade the legal consequences<\/li>\n<\/ul>\n<p>All Parties to the Convention are obliged to co-operate with each other and to afford each other, upon request, the widest possible measure of assistance in the identification, tracing and confiscating of illicit property.<br \/>\n&nbsp;<br \/>\n&nbsp;<br \/>\n<strong>The <em>Council of Europe<\/em> <em>Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime and on the Financing of Terrorism<\/em> <\/strong>(CETS No. 198<strong>)<br \/>\n<\/strong><\/p>\n<p><a href=\"http:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-xpatscom.jpg\"><img decoding=\"async\" class=\"alignleft wp-image-6700\" src=\"http:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-xpatscom.jpg\" alt=\"\" width=\"250\" height=\"121\" srcset=\"https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-xpatscom.jpg 565w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-xpatscom-300x145.jpg 300w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-xpatscom-560x272.jpg 560w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-xpatscom-260x126.jpg 260w, https:\/\/www.europewatchdog.info\/wp-content\/uploads\/2015\/03\/Money-laundering-xpatscom-160x78.jpg 160w\" sizes=\"(max-width: 250px) 100vw, 250px\" \/><\/a>This Convention is an update as well as an extension of the <em>Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime (CETS No. 141)<\/em>. It takes into account, that terrorism can not only be financed through legitimate undertakings, but also through money gained from criminal activities.<\/p>\n<p>It is the first international treaty covering both the prevention and the control of money laundering as well as the financing of terrorism. The Convention entered into force in 2008 and is open to Council of Europe member states as well as to all states, which have participated in its elaboration.<\/p>\n<p>State parties to the Convention are asked to adopt legislative and other measures in order to assure that they are able to:<\/p>\n<ul>\n<li>search, trace, identify, freeze, seize and confiscate property, of a licit or illicit origin, used or allocated to be used for the financing of terrorism<\/li>\n<li>provide co-operation as well as investigative assistance to each other<\/li>\n<\/ul>\n<p>&nbsp;<br \/>\n<strong>Financial Intelligence Units (FIU)<\/strong><\/p>\n<p>In order to strengthen the international co-operation and facilitate it, State parties to the Convention are obligated to establish a Financial Intelligence Unit (FIU).<\/p>\n<p>This term describes a national agency responsible for requesting, receiving, analysing and disseminating to the competent authorities suspicious financial information with regard to suspected proceeds and potential financing of terrorism. When necessary, these units co-operate with the units of the other State parties.<strong><br \/>\n<\/strong><br \/>\n&nbsp;<br \/>\n<strong>Monitoring<\/strong><\/p>\n<p>The <em>Conference of the Parties (COP)<\/em> has been set up in order to <strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/international-treaties\/treaties_and_monitoring\/\" title=\"Treaties &#038; Monitoring\">monitor<\/a><\/em><\/strong> the proper implementation of the Convention by the State parties, as well as to express an opinion on any question concerning the interpretation and application of the Convention the Parties might have.<\/p>\n<p>Each State party to the Convention has one vote in the COP and may appoint up to three representatives. Entitled to participate in the annual plenary meeting without the right to vote are the <strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/council-of-europe\/\" title=\"Council of Europe\">Council of Europe<\/a><\/em><\/strong> observer states, various bodies of the Council of Europe like the <strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/structure\/committee-of-ministers\/\" title=\"Committee of Ministers\">Committee of Ministers<\/a><\/em><\/strong> and the <strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/structure\/parliamentary-assembly\/\" title=\"Parliamentary Assembly\">Parliamentary Assembly<\/a><\/em><\/strong> as well as expert groups such as <strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/instruments\/expert-bodies\/moneyval\/\" title=\"Moneyval\">MONEYVAL<\/a><\/em><\/strong>, the European Committee on Crime Problems (CDPC), <strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/partial-agreements\/corruption\/\" title=\"Fight against Corruption \u2013 and GRECO\">GRECO<\/a><\/em><\/strong>, the Financial Action Task Force (FATF) and the Eurasian Group (EAG).<\/p>\n<p>The COP is free to invite further stakeholders to its meetings like the United Nations, the Organization for Security and Co-operation in Europe (OSCE), the International Monetary Fund (IMF), the World Bank or INTERPOL.<br \/>\n&nbsp;<br \/>\n&nbsp;<br \/>\n<strong>The Bureau<\/strong><\/p>\n<p>The Bureau acts as a board to the COP and ensures the preparations of its meetings. It consists of the President and the Vice-President &#8211; elected for a term of office of two years, renewable once &#8211; as well as three regular members of the COP. The Bureau is assisted by a <strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/structure\/secretariat\/\" title=\"Secretariat\">Secretariat<\/a><\/em><\/strong> headed by an Executive Secretary.<br \/>\n&nbsp;<br \/>\n&nbsp;<br \/>\n<strong>Monitoring procedure<\/strong><\/p>\n<p>Monitoring is carried out by means of a questionnaire, sent to each member state. It addresses areas covered by the Convention that are not covered by other relevant international standards on which mutual evaluations are carried out by <strong><em><a href=\"http:\/\/www.europewatchdog.info\/en\/instruments\/expert-bodies\/moneyval\/\" title=\"Moneyval\">MONEYVAL<\/a><\/em><\/strong> and the Financial Action Task Force (FATF).<\/p>\n<p>Information provided by these two expert bodies, however, can be taken into consideration by the COP, when it prepares its monitoring report, which is based on the answers to its questionnaire and includes recommendations.<\/p>\n<p>Each monitoring report drafted by the COP is discussed during a plenary meeting in a peer-review process. After its adoption, it is sent to the Party being assessed to check its accuracy with decisions taken by the COP, and to provide comments before it is being published.<br \/>\n&nbsp;<br \/>\n&nbsp;<br \/>\n<strong>Follow up<\/strong><\/p>\n<p>The follow up process consists of an update by the State parties on their progress, followed by a written analysis of these updates provided by the COP Secretariat and debated by the COP plenary.<strong><br \/>\n<\/strong><br \/>\n&nbsp;<br \/>\n<strong>MONEYVAL<\/strong><\/p>\n<p>MONEYVAL &#8211; the <em>Committee of Experts on the Evaluation of Anti-Money Laundering Measures and the Financing of Terrorism<\/em> &#8211; is an independent Council of Europe monitoring instrument. It was established in 1997 and answers directly to the Committee of Ministers since 2011.
